4. Bidder Selection Method
ㅇ Bidding Method : Restricted Competition / Lump-Sum Bidding
ㅇ Contracting Method : Contract by Negotiation (in accordance with Article 43 of the Enforcement Decree of the Act on Contracts to Which the State Is a Party)
- Evaluation Method : Technical Proposal+Price, Comprehensive Evaluation (Proposal:Price = 90:10)
ㅇ The evaluation schedule will be announced separately after the deadline for submission of proposals. Bidders shall submit, together with the proposal, presentation materials in PPT or PDF format summarizing the contents of the proposal. The presentation materials must be submitted in a version with all information identifying the bidder removed.
5. Eligibility to Participate in the Tender
ㅇ Pursuant to Article 14 of the「 Regulations on the Operation of Contract Affairs of Other Public Institutions 」, Article 27 of the「Act on Contracts to Which the State Is a Party 」, and Article 76 of the Enforcement Decree of the Act on Contracts to Which the State Is a Party, the bidder must not fall under any of the following categories: (i) a person or entity clearly determined to be likely to impair fair competition or the proper performance of the contract; or (ii) a person or entity whose eligibility to participate in a tender has been restricted as an improper business entity.

※ For the redacted copy, all information that could identify the proposing company, including the company name, corporate identity (CI), and representative's name, must be removed from both the cover and the body of the proposal before submission. Failure to remove such information may result in a disadvantage during the evaluation.

※ Failure to submit documents demonstrating eligibility to participate in the tender will result in the proposal not being accepted.
※ The above documents must have been issued on or before the day preceding the bid submission deadline and must remain valid as of the bid submission deadline. Documents whose validity period has expired as of the bid submission deadline will not be accepted.
8. Invalidation of Bid
ㅇ A bid submitted by a person or entity that is not eligible to participate in the tender.
ㅇ The successful bidder fails to enter into the contract within the prescribed period.
ㅇ Where the bidder, prior to participating in the tender, had entered into a commissioned service contract with the Korea Creative Content Agency (KOCCA) and was assessed as having failed to perform the contract faithfully.
◎ Other Matters
ㅇ Any person or entity intending to participate in the tender shall fully familiarize themselves, prior to submitting a bid, with all matters necessary for the tender, including the Request for Proposal (RFP) and any other relevant documents. The bidder shall bear full responsibility for any failure to familiarize themselves with such matters.
ㅇ If any information contained in the submitted documents is found to be false or exaggerated (including, but not limited to, cases where the monthly participation rate of assigned personnel exceeds 100%), the bidder may be excluded from the evaluation, and the contract may be cancelled or terminated. The bidder shall be liable for any damages arising therefrom.
* Regarding the Calculation of Labor Costs for Assigned Personnel
- Personnel assigned to this project shall have a monthly participation rate of at least 30% during the project performance period (with a participation rate of 0% for any month in which the personnel do not participate). The total participation rate, including participation in all other projects being performed, shall not exceed 100%.
ㅇ The Implementation Plan under Ⅲ. Project Management of the Request for Proposal (RFP) Preparation Guidelines is mandatory and must be included in the proposal (refer to the RFP template).
ㅇ The submitted proposal may not be modified or supplemented without the prior approval of the Agency, and the bidder shall bear all costs and expenses incurred in connection with this proposal.
ㅇ After submitting the proposal, bidders must ensure that the proposal has been successfully and finally submitted. The bidder shall bear full responsibility for any consequences arising from failure to confirm the final submission of the proposal.
ㅇ If the proposal (electronic copy) is not received by the server by the submission deadline, including cases where it is submitted through a channel other than the designated submission method specified above, or if there is any defect in the attached files, the proposal shall be deemed not to have been submitted. Failure to submit the proposal shall result in the bid being deemed invalid.
ㅇ If necessary, the Agency may request supporting documentation to verify the contents of the proposal, and the bidder shall comply with such request.
ㅇ For the protection of the parties being evaluated and other relevant purposes, the entire technical evaluation process may be audio-recorded.
ㅇ All research materials and other deliverables produced in the course of performing the services shall be the property of the Korea Creative Content Agency (KOCCA) and shall not be provided to any third party or used for any purpose other than the performance of these services without the prior approval of KOCCA.
ㅇ Upon execution of the contract, the successful bidder shall submit one copy of the Confidentiality Agreement. (Refer to the Standard Contract Form)
ㅇ The results of satisfaction surveys concerning similar or comparable commissioned services performed by the proposing company for the Korea Creative Content Agency (KOCCA) during the current year and the preceding two years may be provided as reference materials during the technical evaluation of this tender, subject to the request and consent of the evaluation committee members.
ㅇ When submitting a proposal for a service contract by negotiation, the bidder shall submit the “Confirmation Form on Whether Former Korea Creative Content Agency (KOCCA) Employees Serve as Executives or in Other Positions” (Prescribed Form). Where applicable, a deduction of evaluation points will be applied. If any information provided in the submission is found to be false or inaccurate, the award may be cancelled, the contract may be rescinded or terminated, and the bidder may be subject to restrictions on eligibility to participate in tenders.
ㅇ If any unfair conduct, including prior contact with members of the evaluation committee, is identified during the tendering or evaluation process, a deduction of evaluation points will be applied. If such a violation is discovered after the conclusion of technical negotiations, the award may be cancelled, the contract may be rescinded or terminated, and the bidder may be subject to restrictions on eligibility to participate in tenders as an improper business entity pursuant to the「Act on Contracts to Which the State Is a Party」.
ㅇ The Agency may request the bidder or contracting party to submit relevant documents for the purpose of verifying any violations of the Agency's rules or requirements, and the bidder or contracting party shall fully cooperate with such request unless there are exceptional circumstances.
ㅇ The above notice is subject to change depending on the circumstances of the Korea Creative Content Agency.
